Title

A Resolution of the City of Coral Gables, Florida, relating to the collection and disposal of solid waste and recyclable materials in the City of Coral Gables, Florida; establishing the rate of assessment for residential property located within the City; imposing solid waste service assessments against residential property located within the City for the fiscal year beginning October 1, 2016; approving the solid waste assessment roll; confirming the amended and restated initial assessment resolution; and providing an effective date. (For those residents who have already paid the solid waste assessment by the early payment deadline, this Resolution does not affect them).

Body

Pursuant to City Code Section 54-187, the City of Coral Gables charges and collects fees for garbage and trash collection services provided by the City of Coral Gables. In 2015, the City Commission directed that any residential properties with delinquent Solid Waste Collection Fees in excess of $850 that remain unpaid should be collected pursuant to the Uniform Method of Collection provided in Section 197.3632, Florida Statutes. The City Commission further directed that in Fiscal Year 2016-17, all additional delinquencies plus the fees for all residential properties should be collected as a special assessment pursuant to the Uniform Method of Collection provided in Section 197.3632, Florida Statutes.

 

The City adopted a Master Service Assessment Ordinance (Ordinance No. 2015-09), which outlines the procedures for the annual implementation of service assessments and their collection pursuant to the Uniform Method of Collection. On June 14, 2016, the City adopted resolution No. 2016-148, which established the following rates for solid waste collection and disposal services: General Residential Units Annual Rate of $869 and discounted rate of $743; and Auxiliary Living Units Annual Rate of $435 and discounted rate of $371.  That same date, the City adopted an Amended and Restated Initial Assessment Resolution (Resolution No. 2016-149), which initiated the process to place these solid waste charges on the tax bill for collection. Residential property owners were allowed to prepay the discounted annual rate by August 15, 2016, and be removed from the assessment roll. All required notices have been provided to affected property owners in accordance with the Master Service Assessment Ordinance and the Amended and Restated Initial Assessment Resolution.

 

Pursuant to the Master Service Assessment Ordinance, the final step for the imposition of the solid waste assessments is the adoption of an Amended and Restated Final Assessment Resolution.  The Amended and Restated Final Assessment Resolution for Solid Waste confirms the Solid Waste Cost, the method of apportionment and rate of assessments proposed in the Amended and Restated Initial Assessment Resolution. It also adopts the final Solid Waste Assessment Roll and directs that the roll be certified to the Tax Collector for collection no later than September 15.
