Title
A Resolution accepting the recommendation of the Chief Procurement Officer to authorize a new Application Software Support Agreement for citywide Police and Fire 911 Dispatch software, Records Management System, and mobile communication software licenses with Open Software Support Solutions, d/b/a SunGard Public Sector, Inc., in the amount of $1,161,480.20 for a five (5) year period under Section 2-678 (10) of the Procurement Code entitled Exemption (copyright material).

Body
The purpose of this agreement is to provide application software support for the computer aided dispatch software utilized in the Communication Section of the Police Department that is vital for Police and Fire emergency communications.

On December 12, 2001, the City executed an agreement for application software support with Open Software Support Solutions, d/b/a SunGard Public Sector, Inc. with an option to renew after the first year of the contract. This agreement has been renewed each year for a period of ten (10) years. As contracts may not be extended for more than ten (10) years under Section 2-825 of the Procurement Code entitled “Multi-Year Contracts,” a new five (5) year contract is proposed to maintain this proprietary software from January 1, 2017 through December 31, 2021 for a total cost of $1,161,480.20.

Under Section 2-678 (10) of the Procurement Code entitled “Exemptions,” this new Application Software Support Agreement is exempt from the Procurement Code as “copywrite material” and thus, is not subject to the formal solicitation requirements. It is also in the best interest of the City to enter into this new agreement for application software support instead of abandoning the current computer aided software that has been in place for ten (10) years in favor of soliciting a new and potentially more costly and unproven software product.
