A Resolution accepting the recommendation of the Public Works Director to authorize contract negotiations with State Contracting and Engineering Corporation (SCEC) and further authorizing the City Manager to execute phase one of the contract to provide design phase services during design, and if necessary, with the other short-listed firm, as the Construction Manager at Risk for the Miracle Mile and Giralda Avenue Streetscape project pursuant to Section 2-1089 of the City of Coral Gables Code of Ordinances and Request for Qualifications (RFQ) 2015.12.05.  (Continued from the March 24, 2015 City Commission Meeting)
Body
The purpose of this Request for Qualifications (RFQ) statement of qualifications is to select a qualified Construction Manager at Risk firm to provide design phase services during the design of the project and serve as the general contractor during the construction of the project for the successful completion of the Miracle Mile, Giralda Avenue Streetscape, and Biltmore Way (the "Project").   The Project calls for the transformation of the public realm between building facades on both sides of the street.  When completed, the downtown will be more visitor-friendly and better poised for economic growth.
 
On January 22, 2015, two (2) qualifications statements were submitted in response to the RFQ by the following: State Contracting and Engineering Corporation and Ric-Man International, Inc.  
 
On February 26, 2015, the Evaluation Committee met to evaluate the qualification statements, to hear presentations and to conduct interviews of firms who submitted qualification statements.  After the presentations and interviews, the Evaluation Committee selected both firms to recommend to the Commission in the following order of preference: SCEC and Ric-Man.  A summary of the selection committee's rationale for selecting the firms in this order is included as Attachment 3.
 
The above firms selected in order of preference deemed to be the most highly qualified to perform the required services will be invited to enter into a negotiations phase to determine their compensation that will be paid under contract with the City.  Should the City be unable to negotiate a satisfactory contract with the firm considered to be the most qualified at a price the agency determines to be fair, competitive, and reasonable, negotiations with that firm must be formally terminated. The agency shall then undertake negotiations with the second most qualified firm.   After compensation has been negotiated with the consulting firm, the contract will be submitted to the City Commission for approval.  
 
On March 10th, 2015, the second ranked firm, Ric-Man, filed an official protest (included in Attachment 4) challenging the rank order of the selection committee. On March 18th, 2015, SCEC responded to the Ric-Man's protest (included  in Attachment 5).  In accordance with the City Code, the recommendation to move forward with the selection of the CMAR firm was immediately stayed. Subsequently, the Chief Procurement Officer, in consultation with the City Attorney thoroughly reviewed and considered all factors presented in the protest. As a result of this review, the Chief Procurement Officer concluded (Attachment 4) that the evaluation committee followed proper RFQ evaluation criteria and recommended to proceed with the selection committees recommended rank order of SCEC first ranked and Ric-Man second ranked.  The City Manager reviewed the protest and concurs with the City Attorney and Chief Procurement Officer's recommendations.
