Title
A Resolution authorizing an encumbrance in the amount of $40,751.58, or 15%, of the State Forfeited Asset Fund (F.A.F.) monies to provide for the funding of future crime prevention or school resource officer programs, as required under FSS 932.7055, the Florida Contraband Forfeiture Act.
Body
The F.A.F. consists of certain seized monies and the proceeds from the sale of certain forfeited property received from both Federal Asset Sharing and State Forfeiture Proceeds. Under FSS 932.7055, the Florida Contraband Forfeiture Act, a local law enforcement agency must expend or donate no less than 15% of State Forfeited Assets for specific crime prevention, drug prevention, youth resource officer or safe neighborhood programs. The Contraband Forfeiture Act allows the Chief of Police and the City Commission to expend or donate funds over a period of years (number of years not specified) if the minimum amount in a fiscal year would exceed the needs of the municipality for such programs as specified by the Act. If approved, a portion of the encumbered funds will be expended on the Police Athletic League (PAL), Police Explorers and Rape Aggression Defense (RAD) Programs. The remainder of the encumbered funds will be expended or donated to school resource officer, crime prevention, safe neighborhood, drug abuse education, or drug abuse prevention programs, or as the City Commission deems appropriate.    The City Forfeited Asset Fund (F.A.F.) Committee met on July 10th, 2008, and approved the recommendation to encumber a total of $40,751.58 or 15%, of State Forfeiture Funds as required by the Florida Contraband Act.
