Title

A Resolution of the City Commission approving an agreement for commissioned artwork with Fung Collaboratives and Kiki Smith for a temporary public art exhibition approved pursuant to Resolution No. 2020-153.

Body

On July 14, 2020 the City Commission approved a public exhibition by Kiki Smith.

 

The proposed agreement for Commissioned Artwork with Fung Collaboratives and Kiki Smith was drafted to include comments from the Commission, including the following terms:

 

a.                     The total cost to be paid by the City to Fung Collaboratives under this Agreement shall be $200,000.00;

b.                     Fung Collaboratives shall coordinate the design, fabrication, transportation, inspection, and installation of the Artwork at Giralda Plaza;

c.                     The project schedule contemplates the initial installation beginning in November 2020, with a second installation in November 2021, with the City reserving the right to modify the project schedule due to circumstances surrounding the Covid-19 pandemic, provided that if the initial installation is delayed until November 2021, the City will be allowed a second installation beginning in November 2022;

d.                     The City shall have a right of first refusal to purchase the Artwork at a purchase price to be determined after fabrication and installation less a credit as determined by the Artist pursuant to this agreement.  Such a purchase will be memorialized in a separate agreement to be approved by the City Commission.

 

the City Commission wishes to authorize the City Manager to execute the Agreement in substantially the form attached and to authorize the City Manager to make modifications to the project schedule as necessary due to circumstances surrounding the Covid-19 pandemic.
