On June 12, 2018, the City Commission passed and adopted Resolution 2018-165 to award, negotiate and execute a contract with Ashbritt, Inc. (Primary), Ceres Environmental Services, Inc., (Secondary), and Phillips and Jordan, Inc., (Tertiary)

 

The Professional Services Agreement with Ashbritt Inc. and Ceres Environmental Servies, Inc. were executed by the City on August 21, 2018, and with Ceres Environmental Services, Inc. on December 5, 2018 for a three (3) year period, expiring on August 20, 2021, with the option to renew for two (2) additional two (2) year periods, with a final expiration date of August 20, 2025.

 

On July 5, 2023, Ashbritt, Inc. requested and the City approved a nine point seven percent (9.7%) rate adjustment for 2022 and a nine percent (9%) rate adjustment for 2023 based on the rise in the Consumer Price Index for those years.

 

The City and Professional now desire to extend the Agreements from August 20, 2025, to November 30, 2025, to coincide with the end of the Hurricane Season. 

 

It was confirmed that contract changes are allowed by FEMA as long as documented procurement policies and procedures are followed pursuant to 2 C.F.R § 200.317.

 

Section 2-585 of the Procurement Code, entitled “Authority” authorizes the City Manager to delegate authority to the Chief Procurement Officer to administer and make recommendations on contract modifications.
