Title
Resolution declaring the contents of the Preston Scott Design with Flowers Store surplus city property, in accordance with Section 2-920 of the Procurement Code, to authorize disposal of said property by public auction on December 20, 2009.
 
Body
After nearly twenty (20) years in business in Coral Gables, Preston Scott Design with Flowers Store closed in August 2009.   When the store closed the owners left the contents of their store in a retail space leased from the City, which is located on the street level of Parking Garage No. 2 at Aragon Avenue and Ponce de Leone Boulevard.
 
On September 23, 2009, the City of Coral Gables came into possession of the contents of the Preston Scott Design with Flowers Store after the United States Bankruptcy Court Southern District of Florida abandoned the contents to the City of Coral Gables as the landlord and creditor.  The contents of the store consist of retail gift and home décor items and the displays, furnishings and equipment of the store, all which are generally in good condition.
 
The contents of the store should be disposed of as surplus property in order to recoup unpaid rent and other expenses owed to the City and to allow for re-lease of this storefront.
 
In accordance with Section 2-920 of the Procurement Code, property with a fair market value in excess of $25,000 must be declared surplus by the City Commission in order for the property to be disposed of by the Chief Procurement Officer.  The Chief Procurement Officer will dispose of this property by public auction and has made arrangements to utilize the auction company, J. Sugarman Auction Corporation, through a Broward County Piggyback Contract.  Under this piggyback contract the auctioneer will be paid a 10% premium fee that will be added to each item sold and will be paid by the purchaser.
