Resolution rescinding the award of the Segovia Streetscape Improvements Project to McBayne’s Construction and Renovation, Inc. pursuant to Section 2-829 of the Procurement Code entitled “Approval of Change Orders and Contract Modifications.”

On December 14, 2010 the Segovia Streetscape Improvements project was awarded to McBayne’s Construction and Renovation, Inc. A requirement of the Segovia Streetscape Improvements For Bid (IFB) 2010.09.27 were performance and payment bonds in the amount of one hundred percent (100%) of total project total, which in the case of this project would be $696,262.50. On December 15, 2010 a Notice of Award was issued to the contractor requesting performance and payment bonds as required under Section 2-1005 of the Procurement Code entitled “Performance and Payment Bonds and Section 1.15 of Invitation For Bid (IFB) 2010.09.27.
Since the Notice of Award was mailed, Public Works made numerous attempts by email and phone with the contractor and the bonding agent to obtain the performance and payment bonds, but have been unsuccessful. On February 11, 2011, a letter was sent by certified mail from the City Attorney setting a deadline of February 21, 2011 to submit the required performance and payment bonds to the City. To date, the City has not received the required performance and payment bonds.
