Title

A Resolution of the City Commission accepting the recommendation to waive the competitive bid process of the Procurement Code and contract with HG Construction Development & Investment, Inc. for the Phillips Park Renovation Project, located at 90 Menores Avenue, in an estimated amount of $900,000 or not to exceed the available budget, pursuant to Section 2-691 of the Procurement Code, titled "Special Procurements/Bid Waiver."

Body

On August 26, 2025, the City Commission awarded Invitation for Bid (IFB) 2025-015 to HG Construction Development & Investment Inc. for enhancing and modernizing the city park’s recreational facilities, infrastructure, and overall layout.

 

As construction progressed, the scope expanded to deliver a multidisciplinary sports park  including an exercise courtyard, pickleball courts, and renovated basketball and tennis courts. It was also determined that the existing gazebo was beyond repair and required complete replacement, while the restroom building needed full renovation to meet operational standards.

 

In order to expedite procurement and construction activities, minimize impacts from park closure, and meet the City’s operational needs. Allowing HG Construction Development & Investment Inc. to proceed with the additional scope will avoid delays and eliminate potential conflicts that could arise from having multiple contractors on the same site. It is also financially prudent to maintain the current contractor, mitigating mobilization and general condition costs.

 

Pursuant to Section 2-691 of the Procurement Code, titled "Special Procurement/Bid Waiver," the City Manager is authorizing a Bid Waiver to engage HG Construction Development & Investment Inc to implement improvements described above, with costs not to exceed $900,000 or in an amount not to exceed the available budget.

 

Staff recommends that the City Commission approve the bid waiver and authorize HG Construction Development & Investment Inc. to proceed, ensuring timely completion of enhancements and continued delivery of high-quality recreational facilities for the community.

Fiscal Impact

Expediting the award process to HG Construction Development & Investment Inc. will allow the City to complete the park renovations in a timely manner and facilitate the park’s reopening for the neighboring community. Proceeding with the current contractor will also minimize the additional costs associated with procuring a new contractor, including potential remobilization and other related expenses.
