CITY MANAGER'S RECOMMENDATION:

That  a Resolution setting forth conditions of approval for encroachments into the right-of-way consisting of drop-off area, trees and planting materials, tree grates, irrigation system, trash receptacles, benches, special paving, exterior lighting fixtures, and decorative street lights adjacent to 4100 Salzedo Street, be passed and adopted. 

BRIEF HISTORY:

The proposed encroachments are required pursuant to Resolution No. 2004-94, passed and approved May 11, 2004, and are part of the then proposed Mixed Use Overlay District 3 (MXD3).

 

A Resolution setting forth conditions of approval for encroachments into the right-of-way consisting of drop-off area, trees and planting materials, tree grates, irrigation system, trash receptacles, benches, special paving, exterior lighting fixtures, and decorative street lights, on property legally described as: 

 

Lots 1 through 21, inclusive, Block 2, REVISED PLAT OF CORAL GABLES INDUSTRIAL SECTION, according to the Plat thereof, as recorded in Plat Book 28,  of the Public Records of Miami-Dade County, Florida, be approved subject to the following requirements of the Public Works Department:

 

a.                     That the proposed encroachments be constructed in accordance with the Florida Building Code, and all other pertinent Codes.

 

b.                     That final landscaping and irrigation plans shall be approved by the Public Service Department or the Landscaping Encroachment Review Committee.

 

c.                     That final detailed plans, including irrigation, lighting, paving and drainage shall be approved by the Public Works Department.

 

d.                     That any fixed structure including signs be located at least four feet (4'-00") from the face of the curb.

 

e.                     That the City of Coral Gables reserves the right to remove add, maintain, or have the Owner remove, any of the improvements within the right-of-way and at Owner's expense.

 

f.                     That the Owner maintains the proposed encroachment in good condition at all times, and at Owner's expense.

 

g.  That the Owner meet with the City Attorney's office for the purpose of providing all the information necessary for that office to prepare a Restrictive Covenant to be executed by the Owner which runs with the title of the property, and which states, in addition to the above mentioned, that the Owner of the property will provide Public Liability Insurance coverage for the encroachment in the minimum limits required by the City, and naming the City as an additional insured under the policy.

 

h.                     That copies of the Restrictive Covenant, when fully executed and filed, together with certification of required insurance, shall be presented to the Building Department and to the Public Works Department and permits thereafter be obtained for the work from both of these Departments.

 

i.  That the Owner shall replace, at the Owner's expense, any portion of the encroachments affected, in the event the Public Works Department must issue a permit for a utility cut in the future, in the area in which the encroachments are approved, the Owner shall replace the proposed encroachments so cut by the utility, at Owner's expense.
