A Resolution of the City Commission of the City of Coral Gables, Florida, (“City”) authorizing communications, under certain circumstances, between governmental officials regarding the citing of governmental facilities within the City, providing for an effective date.
Body
The siting of governmental facilities has been, in accordance with City Attorney opinions, a quasi-legislative act, neither quasijudical nor an adjudication of rights. As such, the appropriate standard of approval for such facilities is based on a balancing of interests test.
Because permitting communications between government officials and/or their representatives is in the public interest, this resolution clarifies that such communications in connection with a quasi-legislative action are permitted. In order to provide for a transparent process, the ordinance adopts the procedure in state law for disclosure of communications in quasijudicial hearings, although the siting government facilities as noted is not quasijudicial.
